The divorce between “Gossip Girl” star Kelly Rutherford and her second husband, German multi-millionaire David Giersch, has turned ugly – Charlie Sheen and Denise Richards ugly, that is!

The 40-year-old actress, who is currently pregnant with the couple’s second child, filed for divorce from Giersch last month (she cited irreconcibale differences on the paperwork, which was submitted to a judge at Los Angeles Superior Court), seeking sole custody of their 2-year-old son with monitored visitation for her soon-to-be ex-husband. Exactly the same day, Giersch filed for legal separation, seeking sole custody with visitation for her, according to court papers obtained by People Magazine.
A few weeks later, Rutherford asked the court to prohibit her estranged husband from leaving the U.S. with their son Hermés because she fears that they might disappear. “I feel there is some risk that he will leave the country with Hermes and I will not know where they are,” Rutherford reportedly said and added that Giersch may be wanted for crimes in his homeland Germany.
Rutherford also asked the court to allow her to take her son with her to New York for an extended period of time in order to film “Gossip Girl”. However, Giersch immediately fired back by claiming that the actress has a violent temper and that the hotel-lifestyle in New York has a negative effect on their son and his health. “I have been extremely concerned about our son living in a hotel and a New York lifestyle,” Giersch is quoted as saying by People Magazine, “and this has been one of the main reasons, if not the reason for the ending of (Rutherford’s) and my marriage.”
A judge has already denied Rutherford’s request to take Hermes interstate, but will hear these matters further on Jan. 21.
Rutherford married Giersch in August 2006. She gave birth to their first child, a boy named Hermés Gustaf Daniel Giersch on October 18, 2006.
